Dear Friends,

          As all of you are aware that the Govt of India has announced its approval for constitution of the VII th  Pay Commission  for the Central Govt  employees. Its formal constitution with terms & references is awaited.
         
          The 7th Pay commission has been announced by the Govt. We have to make all out efforts to represent before the VII Pay Commission to get best possible recommendations for our cadre in particular and common benefits admissible to all employees in general. This depends largely on how best we are in a position to convince the Pay Commission about our expectations when we get the opportunity to incorporate our legitimate requirements in a memorandum to be submitted to Pay Commission and further justfy the same during the on-screen presentation before the commission.
         
Please find herewith questionnaire  for our branches/members. Get it filled up by the members, compile the same and consolidate. Discuss the consolidated views in EB/GB Meeting draft a proposal and send the same to NEHQ latest by the 15th Jan/2013 for further compilation and discussion in National Council Meeting.

   The sprit behind this is to involve the grass root level of this association in the process of formulating our views/proposals  which are to be sent to the Pay Commission. We  have tried to make out a brief on the specific issues  inviting proposals/views. Your cooperation / involvement, shall help us to make out a memorandum with  full logic and justifications. 
          Remember, Every suggestion you make, matters to the Association.

An Overview on the Earlier Pay Commissions
by Shri RR Pashine, Expert Member/7th CPC Committee

All the six pay commissions have taken many aspects into consideration to prescribe the pay structure for government servants.
1.    In the First Pay Commission  the concept of ‘living wage’ was adopted. (Implemented in  1946 )

2.    In Second Pay Commission it had been reiterated that the pay structure and working condition to be crafted in a way so as to ensure the effective functioning of government mechanism. (Implemented in  1957)

3.    The Third Pay Commission adopted the concept of ‘Need Based wage’ (Implemented in  1973 )

4.    The Fourth CPC had recommended the government to constitute Permanent Machinery to undertake periodical review of pay and allowances of Central Government employees, but which got never implemented.  (Implemented in  1986 )

5.    In Fifth Pay Commission all federations demanded that the pay scale should be at par with the public sector. But the pay commission didn’t accept this and told that the demand for parity with the Public Sector was however difficult to concede as it felt that the Job content and condition of service in the government and public sector not necessarily the same. There were essential differences between the two sectors. The Fifth CPC had Compressed many Scales. The number of pay scales was reduced from 51 pay scales as on 31.12.1995 to 34 pay scales by the Fifth CPC. (Implemented in1996)  
 
6.    The Sixth Pay Commission mainly focused on removing ambiguity in respect of various pay scales and mainly focused on reducing number of pay scales .It recommended for removal of Group-D cadre.The total number of grades reduced to 20 spread across four distinct running pay bands; one Apex Scale and another grade for the post of Cabinet Secretary/equivalent as against 35 standard pay scales existing earlier. The new concept of Pay Band & Grade Pay was introduced and Implemented w.ef. 01- 01- 2006.

Determination of PAY SCALES to arrive at the new pay-scale take into account
Details
(if Our proposal for revision of pay-Scales shall be w.e.f  01-01-2016 , the date from which   we shall demand for implementation of VII th CPC recommendations )
·         Existing Pay Band   . for JWM  is 9300-34800           Grade Pay 4600
·         Dearness Allowance @ 99  to 100% is expected as on 1-1-2014. With the present trend of rise in the Consumer Price Index ,the DA  is expected to be  @ 130 to 135 % (approx)  as on 1-1-2016 .Hence we may formulate the Revised Payscales based on the following factors.
    
    Pay in the Pay Band + Grade Pay + 130% DA(estimated as on 1/1/16)

The Fitment Benefit then be added to it. . In  line with 6 CPC, the fitment Benefit can be reflected through Increased Grade Pay.

·         Interim relief to be granted if any (presently Nil) to be added
·         If any DA is merged with Pay (presently Nil) to be effectively added
·         Estimated Increase in the pay-scale  (How many times of present one) to be mentioned

In the similar way the Min. & Max. in the proposed Pay-scales can be constructed.

(B)  Pay-scales   of our cadre

JWM is the lowest executive in the hierarchy of  Gazetted officers in the ordnance Factories shouldering the entire responsibility of head of section He executes as a vital link between his subordinates & senior officers. It is suggested that since the Revised MACP provides Three Up gradations, the Proposed Pay scale for AWM , WM & DGM posts be also suggested. Further while formulating the pay scale of JWM, it should be kept in mind that there is a continuous degradation /erosion in the payscale of JWM since last three ( 4th to 6th) Pay Commissions. The following factors may also be kept in mind.

The 6th CPC by granting GP of Rs 4600/ had done great injustice with this cadre. The equivalent cadre in other departments performing much lower duties/responsibilities had been granted GP 4800 with provision of elevation to the grade Pay of Rs 5400 after completion of 4 years service.


NON-ACCEPTANCE OF 6th CPC RECOMMENDATIONS AS REFERENCE LEVEL
Hence, the pay scales granted by 6th CPC in respect of JWM cadre can not be  considered to be the acceptable basis for calculating the pay for the next term( 7th CPC) .It is required to be rationalised prior to conversion to the revised Pay-Scale.

Fixation benefit   
Details
As per the practice followed, while effecting the new pay-scales the total emoluments ( BP + DP(if any) +DA +IR as applicable )  , as on the date of effect of the revised pay-scale, is added with the fixation benefit (the fixed %) .At the time of Vth CPC the fixation benefit was given @ 40% of the Basic Pay  In VI th CPC the new system of Grade Pay was evolved which was equal to 40% of the existing end Payscale.At present there is no element of DP(Dearness Pay ie DA merged with Basic Pay) or IR (Interim relief).The existing emoulment consists only Pay in the Pay Band and the Grade Pay.

Restructuring of PB-2
Details
In 6th CPC there was provision of 3 MACP on completion of 10, 20 & 30 year of Service.     It is still not clear that whether MACP will be in Promotional hierarchy OR in Grade Pay hierarchy. However Super court Judgment is in favor of Promotional hierarchy. Now if we got MACP in Promotional hierarchy, then there may be disparities among the same cadre of different departments i.e. in OFB there is no post in 4800 Grade Pay, whether in some departments like "Integral Coach Factory" post at 4800 Grade pay exists. So there is high chance that 7th Pay commission may force to create posts in every Grade pay exists in any particular Pay-band, in the name of removing disparities among the same cadre of different departments. So in order to ensure the betterment of our cadre, some Restructuring of PB-2 is required.

GRANT OF ACP / MACP
Details
After 6 CPC, as per existing provisions of MACP, Central Govt employees can get maximum three financial up gradations after the period of 10/20/30 years of service, in case they have  not got the promotions. But these up-gradations are to be granted in the Next Grade Pay and not in the Next grade Pay of the Promotional level( ie promotional hierarchy).The Principal Bench CAT New Delhi, Pun. & Haryana High Court have already given judgments in favour of granting MACP in Next grade Pay of the Promotional level . The SLP filed by Govt of India in Supreme Court has also been dismissed. But till date the Govt has not given any clearance to implement the same. So the first natural demand becomes Grant of MACPs in the Next Promotional Grade Pay. Any other proposal may also be suggested.

ALLOWANCES :- Dearness Allowance (D A )

Details
Basis of DA 
From 1-1-2006 DA is payable on the average 12 monthly  % increase over  115.763 (BaseYear 2001=100 ) ,to which the revised pay-scale (6 CPC) relate. This is being sanctioned twice in a year payable from 1st Jan & 1st July reckoned on the following basis:-
·         The increase in  twelve monthly average price index (AICPI (IW)   points   
       is determined  twice  in a year for the period ending December & June.
·         The % increase is taken in whole no only and the fraction ignored.
·         Neutralization  is 100% uniformly for all the employees.

After Vth CPC the 50 % DA was merged with Basic Pay and was treated as Dearness Pay (DP) and was being counted for the purpose of Payment of allowances, Transfer grant, Retirement benefits etc. But after 6 CPC this system has been dispensed with and the 50 % DA has not been merged with Pay till date, despite demand from employees federations. So the demand arises that as and when the DA crosses 50% it should be merged with Basic Pay for payments of various allowances/ retirement benefits etc so as to neutralize the effect of inflation  to some extent .Any further proposal may be suggested.

Retirement / Terminal  Benefits - Gratuity
Details
Retirement  Gratuity  is admissible to all the employees who retire after completion of 5 years of qualifying service at the rate of one fourth of the emolument for each completed six monthly period of qualifying service subject to max. of 16 .5  times the emoluments or Rs 10 Lakhs whichever is less. Emoluments include Dearness Allowance on the date of cessation of service

Retirement / Terminal  Benefits - Pension
Details
Amount of Pension  is related  to the length of qualifying service and average of the emoluments drawn by him during Ten months immediately preceding the date of retirement/last pay drawn whichever is beneficial.

Full Pension  is admissible to an employee with qualifying service of not less than 20 years. The amount of Pension will be 50% of the average emoluments/last Pay Drawn  and should not be less than 50% of the minimum of the pay scale held at the time of retirement,subject to min of Rs 3500.

Family Pension  The amount of Family Pension is 30% of the average emoluments/last Pay Drawn by the deceased employee subject to minimum Rs 3500/pm

Increased Pension/Family Pension for Old Pensioners/Family Pensioners

After 6 CPC the following increase in Pension/Family Pension has been made

Retirement / Terminal  Benefits - Commutation of Pension
Details
Every pensioner is eligible to commute a portion (not more than 40% of  his monthly pension for a lump sum payment which is the commuted value of that portion of pension

It is pertinent to mention that after 6 CPC the quantum of payment towards commutation has been considerably reduced/dcreased by the Govt as per Revised Commutation Table.The factor for commutation has been reduced from 9.81to8.194 .  This has cosiderably reduced the total lump some money payable on commutation. The reason being the increase of interest rate on the payment of commutation value from 4% to 8%. The commuted portion of pension is restored after a period of 15 years, even after revising the Commutation Table downwards (reducing the lump some amount payable).The Govt has not reduced the restoration period. As per calculations the Restoration period for commuted pension should be reduced from existing 15 years to 10 to 12 years. This remains the first demand.Other proposals if any be suggested.

Illustration :Commutation Value = Pension Commuted x F x 12

 Existing (Before 6 CPC)  For Rs 1  = 1x 9.81x12  = Rs 117.72 
 Revised  (After 6 CPC)  For  Rs 1  =  x 8.194x12 = Rs 98.328 Difference  =  Rs 19.392

 Thus For Every Rs 1/ Pension Commuted the retiring employee is loosing Rs 19.392  Due to                      
  revised / modified commutation table. Hence  the Justification.

Details

Central Government employees should be allowed to travel to their home town along with their families on three occasions in a block of four years and to any place in India on the fourth occasion.
encashment of Earned Leave upto 10 days along with LTC to the extent of total of 60 days may be continued, the leave encashed at the time of availing LTC should not be deducted from the maximum amount of Earned Leave encashable at the time of retirement. Consequently, the employees would be eligible to encash 300 days of Earned Leave at the time of their retirement,

H.B.A.
Details
Recommendation of 6th CPC which was not implemented as follows:-

Government should enter into agreement with leading PSU banks to extend this facility at pre-determined competitive rates to Government employees. While the employee shall take the loans/advances directly from the bank with the approval of the sanctioning authority in the Government and also repay the installments directly to the bank. The Government will give an interest subsidy equal to 2 percentage points in rate of interest being charged by the bank to the employee.

Details
Currently, the Child care leave is available for Male Employees.  But it can be demanded as-
·         The leave should be available to male employees for 5 years after his child enters in 10th standard, for his children's higher Education.
·         This leave will be available for only 2 children.
·         There will be 100 leaves per child.
·         If Both Husband & wife are Govt employee, then either one can avail child care leave.
·         For male employee, who is either widower & not remarried OR Divorcee & not remarried, should get equal amount of Child care Leaves, upto 18 years of his children as female employee gets.
